FactoRight values your privacy and the protection of your personal data. This privacy policy describes what information we collect from you, how we collect it, how we use it, how we obtain your consent, how long we keep it in our data- bases and, if necessary, with whom we share it.

By using the platform, you are accepting the practices described in this privacy policy. Your use of the platform is also subject to our terms and conditions. In this privacy policy, the words "platform" refers to the FactoRight Google Chrome extension and the website as a whole, "we", "us", "our" and "FactoRight" refers to FactoRight and "you" and "user" refers to you, the user of FactoRight.

This privacy policy may change from time to time. Your continued use of the platform after we make changes to this privacy policy is deemed acceptance of those changes, so please check this policy periodically for updates. This privacy policy has been developed and is maintained in accordance with all applicable federal and international laws and regulations and, in particular, the California Consumer Privacy Act (CCPA), the Virginia Consumer Data Protection Act (VCDPA) and the GDPR (General Data Protection Regulation - European regula- tions).

The App’s use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Notwithstanding anything else in this Privacy Policy, if you provide the App access to the following types of your Google data, the App’s use of that data will be subject to these additional restrictions:

  • The App will only use access to read, write, modify or control Gmail message bodies (including attachments), metadata, headers, and settings to provide a web email client that allows users to compose, send, read, and process emails and will not transfer this Gmail data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets.
  • The App will not use this Gmail data for serving advertisements.
  • The App will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for the App’s internal operations and even then only when the data have been aggregated and anonymized.

You provide information when you download and install the platform, purchase a subscription, use the features available on the platform, subscribe to our newsletter and/or communicate with us through our contact information or contact forms.     FactoRight will not collect any personally identifiable information about you unless you provide it.

    User data: User data generated through the use of the platform will be stored in the platform cache on the user's device. FactoRight does not store user data generated by the user on the platform through its use.

    Payment Information: Your payment details will be processed by the pay- ment processors available on this website (Stripe), which will treat and store your data securely and for the sole purpose of processing the purchase of sub- scriptions. FactoRight reserves the right to engage any payment platform available on the market, which processes your data for the sole purpose of pro- cessing the purchase of subscriptions.

    Social Media: On our website you will find links and functions linked to differ- ent social networks, in which you can share your information. It is advisable to consult the privacy policy and data protection of each social network used on our website.

    Contact information: We may access some personal information about the user, such as name and email address, when the user or any third party com- municates with us through our contact information. Personal information pro- vided through our contact information is not stored on any FactoRight server and will be stored on the respective server of our email service.

  4. 4. HOW LONG WE KEEP YOUR DATA

    Personal data provided by users through the use of the platform will be kept for the time necessary to provide the functionalities available on the platform or until the user decides to cancel the paid subscription or decides to unsubscribe from our newsletter or until the user requests the deletion of his data. FactoRight may retain personal data for a longer period provided that the user has consented to such processing, as long as such consent is not withdrawn. In ad- dition, FactoRight may be obliged to retain personal data for a longer period provided that this is required for compliance with a legal obligation or by order of an authority. Once the retention period has expired, the personal data will be deleted. Therefore, the right of access, the right of deletion, the right of rec- tification and the right to data portability cannot be asserted after the retention period has expired.

    Lawfulness of purpose: Data will be shared for lawful purposes based on a legal basis or justified practical necessity aimed at achieving a public interest without harming national interests, the activities of entities, the privacy of individuals or the safety of the environment - with the exception of data and entities that are protected by law.

    Authorized access: All parties involved in data sharing shall be authorized to view, obtain and use such data (which may require security scanning depending on the nature and sensitivity of the data), in addition to having the knowledge, skill and appropriately qualified and trained persons to handle the shared data.

    Transparency: All parties involved in data sharing processes shall make available all information necessary for data sharing, including: the data required, its purpose of collection, means of transfer, storage methods, controls used for protection and disposal mechanism.

    Joint responsibility:All parties involved in data sharing shall have joint responsibility for decisions regarding data sharing and the processing of data for their specific purposes. They shall also be jointly responsible for ensuring that the security standards stipulated in the data sharing agreement, as well as other related regulations, legislation and policies, are applied.

    Data security:All parties involved in data sharing shall apply appropriate security standards to protect and share data in a secure environment in accordance with related regulations and legislation, and in accordance with data pro- tection regulations.

    Ethical use: All parties involved in data sharing shall abide by ethics during the data sharing process, to ensure the use of data not only within the framework of data security policies or other related regulatory and legislative requirements, but also within the framework of fairness, integrity, sincerity and respect.

  7. 7. HOW WE SHARE INFORMATION

    Information about our customers is an important part of our business, and we are not in the business of selling it to others. We share customer information only as described below.

    Google Services: We use certain Google services to host our platform and allow users to download and install the platform on the Google Chrome browser. By downloading, installing and using our platform, the user may share certain data through Google services.

    Commercial Load Boards:through the use of the platform, FactoRight will be able to access the user's commercial load board and post on the user's behalf, including, but not limited to, searching the load boards, collecting load information, sending communications to intermediaries, making phone calls and other functions. The information provided by the user through the commercial load boards may be shared with load platform providers. Some of these load board providers with whom we may share your information include the following:

    • DAT
    • Truckstop
    • Uber Freight
    • Coyote Logistics
    • Schneider

    Third-Party Service Providers. We use third-party services to perform functions on our website. Examples include: creating and hosting the website, processing payments (Stripe), sending emails, analyzing data, creating ads, providing marketing services and providing search results.

    These third-party services and tools may have access to personal information needed to perform their functions, but may not use that information for other purposes. Information shared with these third-party services will be treated and stored in accordance with their respective privacy policies and our privacy policy.     Email marketing: We use the information provided by users to conduct mar- keting campaigns and send relevant information about our products and ser- vices. By registering as a user on the platform, you authorize us to use your in- formation for email marketing. We will use third-party services and platform to perform email marketing, so we may share certain information with some of these third parties for the sole and exclusive purpose of sending our emails.

    Business Transfers. In the event FactoRight creates, merges with, or is acquired by another entity, your information will likely be transferred. LockTeLoad will send you an email or post a prominent notice on our platform before your information becomes subject to another privacy policy.

    Protection of FactoRight and Others.We release personal information when we believe release is appropriate to comply with the law, enforce or apply our terms and conditions and other agreements, or protect the rights, property, or safety of FactoRight, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

    Anonymous Information. FactoRight uses anonymous browsing information collected automatically by our servers primarily to help us administer and improve the platform. We may also use aggregated anonymous information to provide information about the Platform to potential business partners and other unaffiliated entities. This information is not personally identifiable.

  8. 8. PROTECTION OF YOUR INFORMATION

    We restrict authorized access to your personal information to those persons who have a legitimate need to know that information and to those persons you have authorized to have access to that information. FactoRight follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once FactoRight receives it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while FactoRight strives to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.

    Users who provide information through our platform, as data subjects, have the right to access, rectify, download or delete their information, as well as to restrict and oppose certain processing of their information.     • Access and portability: to access and know what information is stored on our servers, you can send us your request through our contact information.
    • Rectification, restriction, limitation and deletion: You may also rectify, restrict, limit or delete much of your information.

FactoRight is not responsible for the privacy or security practices of other Internet platform, including those linked to or from the FactoRight platform.
